Police have No Right to Pick Up a Person Just on Basis of Allegation
Delhi High Court has given a stern warning to Delhi Police over alleged TORTURE and ILLEGAL DETENTION of student activists, in March 2026. The HC has again emphasized with stern order that Legal Procedures must be followed.
Taking Strong Note of Police Extrajudicial Custody and Torture, The HC said..
When someone makes an allegation against someone, will you just pick up her? We are not going to allow this. If you have some material to suspect them ( the activists ), you have procedure prescribed in law. If you did not, then we are asking Police Commissioner to order an enquiry.
It pointed out that these allegations of torture are very grave which could not be a measure of interrogation.
Even if you may be investigating a terrorist angle, you must have to follow the procedures of law – HC said further to Delhi Police.
Batch Petitions over Torture
The Delhi High Court was listening to Batch Petition over alleged Torture, Misbehaviour and Illegal Detention by Delhi Police. The students were picked up from outside the campuses of Dayal Singh College – New Delhi. A plea has been filed by younger sister of a woman activist named – Lakshita, alleging that she and other students were picked up and taken to an unmarked building in New Friends Colony in New Delhi.
According to the petition, 10 people including 2 human rights activists were previously booked for allegedly raising Pro Maoist slogans at India Gate.
Although the Delhi Police through its defense representation tried vehemently to state that no illegal detention, coercion and torture were executed , rather students were called for lawful questioning.
